A few days ago Microsoft confirmed the deployment of the new system update for the Xbox 360 is firmly scheduled for December 6th, 2011. The upgrade is primarily geared towards strengthening the system shell (how it looks), as well as the Xbox 360 Kinect interactions. So most everyone is complaining that pre-ordering Call of Duty Modern Warfare 3 doesn't come with any cool free stuff when reserving it, and on top of that the price point of $99 for the Hardened Edition doesn't come with much incentive either.
